- "Confidential Information" means any invention details, research data, business ideas, or personal information shared with ThinkNew for the purpose of availing services.
2. Acceptance of Terms
By using this website or engaging ThinkNew's services, you confirm that:
- You are at least 18 years of age or are accessing the website under the supervision of a parent or guardian.
- You have read, understood, and agree to be bound by these Terms & Conditions.
- You have the legal authority to agree to these terms on behalf of yourself or your organisation.

3. Nature of Services
ThinkNew provides advisory, drafting, filing, and documentation support for Intellectual Property (IP) matters. Our services include:

- FER / Office Action Reply Support
- Citation & H-Index improvement services

4. Client Responsibilities
As a client or user of ThinkNew's services, you agree to:
- Provide accurate, complete, and truthful information about your invention, brand, or creative work.
- Ensure that you are the original creator or authorised owner of the IP you wish to register or protect.
- Cooperate fully and respond promptly to requests for information or documentation.
- Review all drafted documents (patent specifications, trademark applications, etc.) before submission and notify us of any corrections.
- Make payments as per the agreed fee schedule within the stipulated time.
- Not use our services for any illegal, fraudulent, or deceptive purposes.
5. Fees & Payments
- Service fees are communicated before commencement and must be agreed upon in writing (email confirmation accepted).
- Government filing fees, stamp duties, and official charges are payable separately and in addition to ThinkNew's professional service charges.
- Fees are non-refundable once service has commenced, unless ThinkNew is unable to provide the agreed service due to its own default.
- Advance payment may be required before drafting or filing commences, as specified in individual service agreements.
- ThinkNew reserves the right to pause services in case of non-payment or delayed payment without prior notice.
6. Confidentiality
ThinkNew takes the confidentiality of your ideas and inventions extremely seriously. We commit to:
- Not disclosing your invention, business idea, research, or personal data to any third party without your explicit consent.
- Signing a Non-Disclosure Agreement (NDA) upon request before discussing sensitive details.
- Using your information solely for the purpose of providing the requested services.
- Storing all confidential documents securely and deleting them upon request post-completion of services.
Note: Confidentiality obligations do not apply to information that is already in the public domain, required to be disclosed by law, or independently developed without reference to your information.
7. Intellectual Property — Ownership
All content on the ThinkNew website — including text, images, graphics, logos, service descriptions, and layout — is the exclusive intellectual property of ThinkNew and is protected under applicable copyright laws.
- You may not reproduce, copy, distribute, or use any website content without prior written permission from ThinkNew.
- Patent specifications, trademark applications, and other documents drafted by ThinkNew for a client belong to the client upon full payment of fees.
- ThinkNew retains the right to use anonymised case summaries (without identifying details) for portfolio, marketing, or educational purposes unless otherwise agreed.
8. Disclaimer of Warranties
ThinkNew provides its services on an "as available" basis. We do not guarantee:
- That a patent, trademark, or copyright application will be approved by the respective authority.
- That the granted IP rights will be free from future challenges or oppositions.
- Specific timelines from government authorities, as these are outside ThinkNew's control.
- That the website will be uninterrupted, error-free, or free from viruses.
9. Limitation of Liability
To the maximum extent permitted by applicable law, ThinkNew shall not be liable for:
- Any direct, indirect, incidental, consequential, or punitive damages arising from the use of our services.
- Rejection of IP applications by government authorities based on prior art, technical deficiencies in client-provided information, or policy changes.
- Delays caused by government processing times, court proceedings, or third-party opposition.
- Loss of data due to unforeseen technical failures beyond our reasonable control.
10. Privacy Policy
Your privacy is important to us. By using our website and services, you consent to the collection and use of your personal information as described below:
- We collect your name, email, phone number, and invention/research details only for service delivery purposes.
- We do not sell, rent, or trade your personal information to third parties for marketing purposes.

11. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.
